Draft, not yet in force. This text describes how Send Dubs works today. It still needs the operator's legal details and a legal review before launch.
The service
Send Dubs lets artists, producers and labels upload unreleased music and send it privately to DJs, and lets DJs listen, download where allowed, and give feedback. It is run by [operator to be confirmed].
Send Dubs is a delivery tool, not a promo pool or a music library. Each sender chooses what to upload and exactly who receives it; we don't select, recommend or offer anyone's music to other users, there is no search across other people's music, and DJs can't pass promos on. Public pages exist only where a sender switches them on for their own music.
Your music stays yours
You keep all rights in what you upload. You give us a non-exclusive, royalty-free permission, only to run Send Dubs for you: to store it, process it (previews, waveforms, analysis, clips, personal watermarked copies), deliver it to the people you choose, and show public release or label pages when you switch them on. It ends when you delete the music, apart from backups for up to 35 days, records we need for takedowns and legal claims, and copies DJs already downloaded under the DJ licence below. If you tick the recognition box for a track, you also allow FilmKode Identify to keep a fingerprint so partner internet radio stations can recognise it when it's played. We never use your music to train AI models.
What you promise
- You are 18 or over if you upload music (16 or over to use Send Dubs as a DJ).
- You have the rights to upload and share the music, artwork and details, and you take responsibility for them, as set out in the uploader agreement you sign before your first upload.
- You only send promos to people who agreed to get them (see acceptable use).
- You keep your account secure.
DJs
A promo gives you a personal licence that you can't pass on: listen, download where the sender allows, and play it in your DJ sets, on radio and in livestreams, unless the sender says otherwise. Don't share links, codes or files, release or sell it, upload it anywhere (including mixes on Mixcloud, YouTube or podcasts before its release date, unless the sender allows it), remove its marks, or use it for AI. Delete your copies if the sender or we ask, or when your access is switched off. Every copy carries a mark linked to you. If you leak a promo we can close your account and tell the sender who you are.
Plans and payments
The free plan has the limits shown on the home page. Paid plans renew monthly through Stripe and can be cancelled any time; you keep the plan until the end of the paid month. Nothing is charged without you choosing it.
Ending things
You can delete your account at any time. We may suspend accounts that break these terms or the acceptable use rules, and we'll tell you why.
Liability
Our total liability to you is limited to the greater of what you paid us in the last 12 months and £100. We are not liable for indirect or consequential loss, or for what recipients do with promos you send, including leaks. Watermarks help trace a leaked copy but can't guarantee it. Nothing here limits liability for death or injury caused by negligence, for fraud, or anything else the law doesn't allow us to limit, and if you use Send Dubs as a consumer your legal rights are not affected.
Changes
We tell you at least 30 days before changes to these terms take effect. If the uploader agreement changes, you sign the new version before your next upload.
Law
These terms are governed by the law of England and Wales, and its courts decide disputes. If you are a consumer living elsewhere in the UK, you can also go to your local courts.
